These terms govern the use of LabelBrain (the “Service”), an internal operations platform built and operated by Create The Culture Limited (“Create The Culture”, “we”, “us”). LabelBrain is a private tool used by Create The Culture staff and authorised label partners. It is not offered as a public consumer product. Access is granted by invitation only and may be revoked at any time.

You must be at least 18 years old to use the Service.
Accounts are provisioned by Create The Culture. You are responsible for keeping your login credentials secure and for every action taken under your account. Do not share access with anyone not authorised by Create The Culture, and let us know immediately at mark@createtheculture.uk if you believe your account has been compromised.
When using LabelBrain you agree not to:
LabelBrain reads and writes data through the official APIs of Meta Platforms, Spotify, TikTok, Snap and Google, among others. All such data remains subject to the terms of those platforms. You must not use data retrieved through LabelBrain in any way that would breach the terms of the originating platform.
The Service, including its software, visual design, and documentation, is owned by Create The Culture or its licensors and is protected by copyright and other intellectual property laws. Nothing in these terms transfers any ownership in the Service to you. Artist data, release assets, recordings, and related rights remain the property of the respective artist and are handled under the recording and services agreements in place with Create The Culture.
Data presented inside LabelBrain — including roster information, commercial performance, ad spend, internal tags and notes — is confidential to Create The Culture. You agree not to disclose it to any third party without written permission, except where required by law.
We aim to keep LabelBrain available and reliable, but we offer no uptime guarantee. The Service may be modified, suspended, or discontinued at any time, with or without notice, for maintenance, security, or any other reason.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Create The Culture makes no warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by law, Create The Culture will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to £100.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under English law.
Create The Culture may suspend or terminate your access to LabelBrain at any time, with or without cause. On termination, your right to use the Service ends immediately. Sections that by their nature should survive — including confidentiality, intellectual property, disclaimers, and limitation of liability — will survive.
We may update these terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Service after any update means you accept the revised terms.
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
